The International Group of Legal Experts on Fusion Energy (FELEX) has just published a discussion paper on the liability regime applicable in the case of radiation damage caused by fusion

FELEX is an informal, independent Group established by Fusion for Energy with the support from the International Nuclear Law Association to provide expertise and guidance on the legal and regulatory aspects of fusion energy development for peaceful purposes. FELEX was created following the Fusion for Energy Roundtable in June 2023, organized by Fusion for Energy with its membership expanding in June 2024 to ensure gender parity and representation from all G7 nations. The Group currently includes 16 Members, a Secretary, a Technical Adviser from the International Atomic Energy Agency (IAEA), as well as 15 Observers from leading organisations such as the IAEA, OECD Nuclear Energy Agency, European Commission, EUROfusion, UK Atomic Energy Authority, the Fusion Industry Association, European Fusion Association, Fusion Europe, and the Clean Air Task Force.
